Terms and Conditions of use

General

• Welcome to Myownisrael.com. Your use of this website (“the Site”) demonstrates your acceptance of the following terms, and your agreement to abide by and be legally bound to them. If you do not agree to these terms, in whole or in part, please do not use this Site.
• Myownisrael.com is an internet-based website that manages a virtual store, offers its customers information and sells a variety of products. This Site is owned byYonatan Machado and Itzik Azoulay (“the Partnership”).

Conditions of Use of the Site

• Use of this Site is for the exclusive purpose of placing orders, purchasing products, and/or procuring information. No other use of this Site is permitted.
• Anyone over the age of 18 and in possession of a valid bank account or an authorized credit card may submit an order to purchase products via the Site.
• The customer’s purchase of products shall be accepted upon fulfillment of the following conditions:
  • existence or creation of an active PayPal account (see below).
  • existence of the requested product/s in stock.
  • the customer must have a personal email account, unless the transaction was carried out by telephone.

Sales and service policies

• The variety of products and services, prices (including shipping expenses), and the conditions of payment on the Site are subject to changes from time to time, upon the sole discretion of the Partnership.
• In the event that a customer places an order and the product is no longer in stock, the Partnership will supply the recipient with as similar a product as possible.
• The delivery will arrive at its destination on the date requested by the customer. The Partnership does not stipulate the hour of delivery, but commits that it will be furnished in the course of the designated day.

Customer details and Site security

• In the process of completing a transaction for the purchase of products from the Site, the customer must supply personal data, details of the order, bank account details and/or credit card details, and so forth (“the Details”).
• The transmission of fraudulent details is a criminal offense. An individual who transmits fraudulent details on the Site will be subject to legal action, including tort claims for damages that may be caused to the Site and/or the Site owners and/or the Site operators and/or Site administers and/or any entity acting on their behalf (“Associates”). In the event of error in the entry of details by the customer (including personal details of the customer), the Partnership reserves the right to cancel the order.
• Neither the Partnership nor its Associates will transfer these details to external sources, excepting the supplier(s), for the sole purpose of completing the transaction initiated by the customer. The Partnership also reserves the right to use the Details for demographic and statistical analysis, and to transfer them to other sources; in which case the data will not reveal any identifying information about the customer.
• The financial details provided to PayPal in the course of the transaction will be protected by the security measures employed by PayPal. For more information, please read PayPal’s Privacy policy.
• If a customer makes a purchase through Myownisrael.com, the Partnership will include him/her in its list to receive email updates about special offers, new products and services, and relevant information. If for any reason the customer does not wish to receive this information or does not wish for the Partnership to provide information as described above, the customer may inform the Partnership and request in writing (including email) to be removed from the list.
• The Partnership’s data processing computer contains a computerized registry of every operation carried out on the Site. This registry will be prima facie evidence of these operations.

Payment for the products

• All of the displayed prices on the Site include Value Added Tax (VAT), unless explicitly stated otherwise.
• This Site utilizes PayPal as the sole method of payment; the customer must have an active PayPal account to complete a transaction on this Site.
• In opening a PayPal account, the customer must provide a bank account number and/or credit card number to link to his/her PayPal account, along with personal contact information required to complete the transaction. For more information about PayPal, please read its User Agreement
• The consideration for the product will be obtained via the financial details provided in the customer’s order, prior to or concurrent with the delivery of the product(s) to the address provided in the order. If, pursuant to Partnership policy, the customer is permitted to make payments in installments, the funds will be withdrawn according to the installment plan.
• The total consideration that the customer must pay appears under "Total Price" in the box titled "Cart" on the right side of each page.

Canceling the order

• If the customer wishes to cancel his/her order, he/she may do so within 14 days, on condition that the purchase has not already been shipped.
• In the event that an order is cancelled, the customer will be charged 5% of the purchase price or 100 Shekels, whichever is less, in accordance with Israel’s Consumer Protection Law, 1981.

Limitation of Liability

• The customer expressly agrees that use of Myownisrael.com is at his/her sole risk. Neither the Partnership, nor its employees, agents, third-party service or content providers, merchants, or the like (“Affiliates”), warrant that Myownisrael.com will be uninterrupted or error-free; nor do they warrant as to the results that may be obtained from the use of Myownisrael.com, or as to the accuracy or reliability of any information content, service, or merchandise provided through Myownisrael.com.
• Myownisrael.com is provided on an “As is”, “As available” basis and the Partnership specifically disclaims warranties of any kind, either expressed or implied, including but not limited to warranties of titles or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by the Partnership or its Affiliates shall create a warranty.
• The Partnership strives to provide products of the highest quality, but clarifies that any and all liability regarding the quality of the products resides solely with the product manufacturers.
• In any event, should the Partnership be held liable under any legal claim whatsoever, in light of the aforementioned procedure, such liability shall not extend beyond the actual consideration paid for the product(s) by the customer.
• The images on this Site are for demonstration purposes only. It is hereby clarified that given the fact that the images are shown via computer screen and/or printed via computer, it is possible that there will be differences between the way the products appear on the Site and the way they actually look.
• The Partnership and/or its Associates do not warrant that the Site or anything emanating from it is free of viruses, pop-ups, or other foreign elements that could harm or destroy the customer’s personal computer and/or any other equipment when he/she enters or uses the Site. Under no circumstances shall the Partnership or its Associates be liable for any direct, indirect, incidental, special, or consequential damages resulting from mistakes, omissions, interruptions, deletion of files or emails, errors, defects, viruses, delays in operation or transmission, or any failure of performance, however these may occur. Furthermore, the Partnership will not be liable for any illegal activity by the customer on the Site, in any way whatsoever, or any third party that is not within the control of the Partnership. The customer hereby acknowledges that this paragraph shall apply to all content, merchandise, and services available through Myownisrael.com. Compensation for inappropriate use of the Site. Anyone who uses the Site in a manner deemed inappropriate by the Partnership will be held liable for damages and compensation to the Partnership and/or its Associates for all claims and/or expenses and/or damages, including legal expenses incurred by the Partnership and/or its Associates.

Ownership and preservation of rights

• The Site contains information data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material (“content”) that are protected by copyrights, trademarks, and other proprietary rights. These rights are valid and protected in all forms, media and technologies existing or hereinafter developed. The customer and/or the browser and/or any third party engaging in activities on the Site (“User”) is not permitted to modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content, in whole or in part, for any purpose whatsoever. The Partnership permits the downloading of data to the User’s personal computer for the purpose of personal use only, and not commercial use, and this permission, and any other legal activity on the Site, does not entitle the User to any proprietary rights in this information and in the content of the Site in general. The User agrees not to upload to or otherwise distribute on the Site any content created or owned by others which is subject to any copyright or other proprietary rights of any third party. The unauthorized submission or distribution of copyrighted or other proprietary third party content is illegal, and the User -not the Partnership, nor its Affiliates or Associates- will be liable for any damages resulting from any infringement of copyrights or proprietary rights, or from any other harm arising from such submission. The User agrees to indemnify the Partnership and/or its Affiliates and/or its Associates for any damage and/or expenses (including legal fees and court fees) that were caused to them as a result of the aforementioned inappropriate actions of the User.
• Anyone requesting to create a link on the Site to other websites must contact the Partnership in advance and request authorization pursuant to its additional conditions.
• Myownisrael.com may terminate the connection, cancel or curtail its services, and prevent the access of Users to any section or part of the Site at any time. The Partnership reserves the right to change the terms of use of the Site, as well as any other pages on the Site from time to time, without notice.
• Any dispute between the User and the Partnership related to activities on the Site may only be adjudicated in a court in Jerusalem, Israel. The laws of the State of Israel shall apply in the event of a dispute.
